CALIFORNIA CONSUMER PRIVACY ACT POLICY

FOR CALIFORNIA RESIDENTS ONLY
THIS POLICY ONLY APPLIES TO RESIDENTS OF CALIFORNIA. PLEASE DO NOT CONTINUE IF YOU ARE NOT A CALIFORNIA RESIDENT.

This policy is supplemental to our Privacy Policy and applies solely to California residents (“Consumers” or “you”) who access this website, utilize its services, and/or provide their information to this website. This policy is presented in compliance with the California Consumer Privacy Act of 2018 (“CCPA”) and other applicable privacy laws of California. The terms defined in CCPA shall have the same meaning when used herein. This policy contains important information regarding our practices for the collection, use, transfer, disclosure and sale of Personal Information from California consumers who submit their information on this website while providing instructions on how to exercise their consumer statutory rights under CCPA. Only California residents, or their authorized registered designated agents, can submit a CCPA request pertaining to their Personal Information for verification and processing. We reserve the right to modify, replace, and amend this policy at any time and for any reason and when modifications are implemented, they will take into effect immediately upon publication and shall replace and supersede any previous terms. Your continued use of the website after such modifications shall constitute your acceptance.

1. REQUEST TO KNOW HOW YOUR PERSONAL INFORMATION IS COLLECTED, DISCLOSED, OR SOLD

California consumers have the right to request that this website reveal to them what Personal Information is collected, used, disclosed, and sold that belongs to them. Consumers can submit their CCPA requests to be verified by us and request to obtain the specific Personal Information we have collected about them by emailing us directly at (EMAIL). Upon receipt of said request, we are required by statute to verify that the consumer requesting the information is the same person with whom we have the information in our databases. To verify identify, we will ask the requesting consumer to provide limited types of information to us for the sole purpose of verifying their identity, which may include, but not limited to:

  • (a) full name;
  • (b) physical address;
  • (c) email address; and
  • (d) last four digits of a social security number.

This requested information shall be limited to the information the consumer initially provided during their submission. Once we verify a CCPA request, we will disclose to a consumer the following:

  1. The categories of Personal Information we collected about the consumer
  2. The categories of Sources for the Personal Information we collected about the consumer
  3. Our Business/Commercial Purpose for collecting or selling the Personal Information
  4. The categories of third-parties with whom we shared that Personal Information

As set forth in our Privacy Policy, we collect several types of information about consumers, either individually or in combinations, when they access and utilize the website, including Personal Information, demographic information, behavioral information, and indirect information. Personal Information is collected directly and indirectly from a consumer’s use of this website and their interactions or communications with this website, such as submission of the loan request form to connect with lenders. This website in return receives monetary compensation for its disclosure or sharing (“passing”) of consumer’s Personal Information with:

  • (i) affiliated entities;
  • (ii) financial service providers;
  • (iii) information/data aggregators;
  • (iv) lenders, including tribal lenders; and
  • (v) advertisers.

The sharing and disclosure of Personal Information is made for the following business and commercial purposes:

  • (a) to obtain the financial services or short-term loan a consumer requests on this website;
  • (b) to allow third-parties to market related products and services to consumers;
  • (c) to resolve consumer inquiries or opt-out requests;
  • (d) to enhance this website and its user experience;
  • (e) to preserve the security of the website and its services; and
  • (f) to respond to any regulatory or government entity inquiries which we are required by law to respond to.

Personal Information under CCPA does not include the following types of information:

  • (a) publicly available information from public or government records;
  • (b) de-identified consumer information;
  • (c) information not included in the scope of CCPA; or
  • (d) personal information covered by certain industry specific privacy laws, including the Fair Credit Reporting Act (“FRCA”), the Gramm-Leach-Bliley Act (“GLBA”), or California Financial Information Privacy Act (“FIPA”).

2. REQUEST TO DELETE YOUR PERSONAL INFORMATION

California consumers have rights under CCPA to request the deletion of their Personal Information if we have collected or maintained it in the past twelve (12) months. To request deletion of your Personal Information by this website, contact us at (CCPA EMAIL) with the Subject Line “CCPA Right to Delete.” Once we are able to verify a consumer and process this deletion request, we will archive their personal information in a secure and encrypted, separate database scheduled for destruction in three (3) years from the date they provided their information to the website. The information will no longer utilized for any purpose. Our website is precluded from processing deletion immediately by contractual and statutory prohibitions set forth in the Telephone Consumer Protection Act (“TCPA”), The Canspam Act of 2003 (“CANSPAM”), and California Business and Professions Code Section 17529.5.

3. REQUEST TO OPT-OUT OF THE SALE OF YOUR PERSONAL INFORMATION

California consumers have the right to opt-out of any sale or sharing of their personal information by a business. Please note that by initially submitting a loan request on this website, you are essentially requesting that we share your information with lenders and third parties to connect to a short-term loan or other financial service. Therefore, this would be an exemption from this statutory right. If a consumer still decides to submit a CCPA request to opt-out of the sale and sharing of their personal information, our website will honor any opt-out request and cease all further sharing of information. Consumers under CCPA have a right not to receive discriminatory treatment for the exercise of their statutory rights and this website does not engage in discrimination. This website and its owners and operators will not deny any consumer services or provide a different quality of service due to the receipt of a CCPA request at any time. Though, if a consumer does exercise their statutory right under CCPA to opt-out of the sharing or selling of their information, then this website will not be able to provide its services because its services principally involve passing information to third-parties.

4. LIMITATIONS AND VERIFICATION

California consumers may only submit a CCPA request to be verified by this website two (2) times within a twelve (12) month period. A “verifiable consumer request” must: (a) provide sufficient information that enables us to reasonably verify the identity of the consumer, ensuring they are the individual about whom the website collected Personal Information; (b) describe the request with adequate detail to allow us to properly understand, and respond to the consumer; specifically, whether a consumer is requesting to know, requesting not to sell, or requesting to delete. For security and privacy reasons, we don’t respond to a consumer’s CCPA request if that request cannot be verified. The Personal Information a consumer provides in a CCPA request to be verified will only be used to verify the requestor’s identity. In addition to the rights provided under CCPA, California residents can also request a list of third parties to whom we have disclosed certain personal information for direct marketing purposes in the preceding calendar year. To make such a request, please contact us using the information provided in this policy.

5. RESPONSE TO REQUESTS

This website responds, and processes verified consumer request within the statutory proscribed time of forty-five (45) days of its receipt. If our website requires more time to process a request, we will provide the consumer written notice and further information about the disposition and extension. This notice will be provided by electronic mail to the contact information a consumer provides.
